1. Acceptance of terms
By downloading, accessing, or using Marky, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use Marky. If you use Marky for another person or organization, you confirm that you are authorized to accept these terms for them.
2. Use of Marky
Marky is a dog-care organization and logging tool. It may help you record walks, care events, notes, records, reminders, voice-assisted entries, and private Local Safety notes. You are responsible for the information you enter, for reviewing important logs, and for using the app lawfully.
Features may change, be limited, or be described as beta or coming soon. We may add, remove, or adjust features as the product develops.
3. Your responsibility for dog-care decisions
You remain responsible for decisions about your dog’s care, health, supervision, route, environment, and safety. Marky is not a veterinarian, does not diagnose, does not prescribe, and does not replace professional veterinary care.
Marky is not an emergency service. Do not rely on Marky to contact a veterinarian, emergency animal hospital, police, animal control, or another responder. In an emergency, contact an appropriate professional or emergency animal hospital immediately.
4. Feature limitations
Location and GPS
Location and route information may be delayed, missing, or inaccurate because of signal conditions, buildings, trees, weather, device settings, battery optimization, provider availability, or other factors. Marky does not guarantee GPS accuracy, route completion, distance estimates, or continuous background tracking.
Voice features
Marky uses Google Assistant and “Hey Google” where supported; it does not use “Hey Marky.” Marky does not always listen. Short follow-up listening begins only after you start a command flow. Voice recognition may misunderstand, omit, or duplicate information, so review important logs. Risky V1 voice actions, including deleting dogs or walks, are not supported.
Local Safety
Local Safety notes are personal notes saved for the user. They are not public alerts, are not shared with nearby users, and do not guarantee that a place, route, animal, or situation is safe or unsafe. Wildlife and safety notes do not guarantee public safety or replace your own judgment.
Notifications and reminders
Notifications may be delayed or not delivered because of permissions, device settings, operating-system behavior, battery settings, or other conditions. Do not rely on Marky for time-critical medical or safety reminders.
5. Accounts, subscriptions, and billing
Marky does not currently represent that accounts, subscriptions, Premium billing, or paid Care Presets are active. If paid services are introduced, the price, renewal terms, cancellation options, and any additional terms will be presented before purchase. This section should be updated before billing goes live.
6. Intellectual property
Marky, its design, software, branding, and original content are owned by Andrew Turley, operating as DaringDrew or its licensors and are protected by applicable intellectual-property laws. These terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use Marky for its intended purpose. They do not transfer ownership of Marky to you.
You retain rights in content you create. You give Andrew Turley, operating as DaringDrew only the limited rights needed to process content for features you intentionally use, such as support, export, or sharing.
7. Acceptable use
You may not misuse Marky, interfere with its operation, attempt unauthorized access, reverse engineer it where prohibited by law, use it to violate another person’s rights, upload unlawful or harmful material, or use it for deceptive, abusive, or illegal activity.
8. Third-party services
Some features may rely on device platforms or third-party services, including mapping, location, speech recognition, Google Assistant, sharing, or app-store services. Their availability and operation are outside Marky’s control and may be governed by separate terms.
9. Disclaimers and limitation of liability
To the extent permitted by law, Marky is provided “as is” and “as available,” without warranties that it will be uninterrupted, error-free, completely secure, or suitable for every purpose. Nothing in these terms excludes rights or liability that cannot legally be excluded.
To the extent permitted by law, Andrew Turley, operating as DaringDrew and its contributors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, opportunities, or goodwill arising from use of or inability to use Marky. Any total liability that can legally be limited will not exceed the amount you paid for Marky during the twelve months before the event giving rise to the claim. This language must be reviewed for the laws that apply to the launch.
10. Suspension and termination
You may stop using Marky at any time. We may suspend or end access to a service if reasonably necessary to protect Marky, users, legal rights, or system integrity, subject to applicable law. Locally stored data may need to be exported or deleted through the app or device before uninstalling.
11. Changes to these terms
We may update these terms as Marky changes. Updated terms will display a new effective date. When required, we will provide additional notice or ask for acceptance.
12. Governing law and disputes
Applicable law governs these terms, including any consumer protections that cannot be waived. A specific governing-law, venue, and dispute provision should be added after legal review and before public launch.
